Terms of Service
Terms and conditions of service for Hills IQ Pty Ltd trading as Sweet Pedals, are set out below.
Payments, cancellations and refunds
Full payment, and where requested a refundable damage deposit, must be received to secure your event date.
We accept all major credit cards, PayPal and direct bank deposit.
If you cancel your booking 7 days or more before your event date, we will refund all payments, less 10% of the total cost of hire to cover administration. If you cancel less than 7 days before your event date, we will refund all payments less 50% of the total cost of your hire package.
We reserve the right to cancel your booking in the event of extreme weather or fire-danger forecasts, staff illness/unavailability, or for any other reason whatsoever that gives us cause to believe there may be risks to the safety or well-being of our staff, our customers or to others.
In the event we have to cancel your booking, we will provide as much notice as reasonably possible and will provide a full refund of any monies paid in respect of equipment hire.
Hire agreement and liability waiver
When hiring equipment from Sweet Pedals, you - the named hirer - agree to the following:
I am over the age of 18 years and legally responsible for myself as defined by the laws of South Australia and Australia.
I will ensure all users of the hired equipment (including any children) do so in a safe and responsible manner.
I have read and will follow the instructions provided to me by Sweet Pedals.
I will be mindful of safety and apply common sense to minimise risk and prevent harm to anybody arising from use of the equipment.
I will ensure the smoothie bike blending equipment is used only for its intended purpose, which is to blend soft, edible foods and liquids.
I will ensure appropriate cleaning, food hygiene and safety methods are applied during use of the equipment.
I will not to use the equipment outdoors during wet, windy or extreme weather conditions.
I take full responsibility for all equipment I hire (as listed in the attached inventory), and will apply suitable precautions against loss, theft and/or damage.
I will pay IN FULL any damage repair or replacement costs in the event of loss or damage to hired equipment that occurs during the hire period.
I will stop using any equipment IMMEDIATELY should it become damaged and I will report this as soon as possible to Sweet Pedals staff.
I will return all hired equipment in a CLEAN CONDITION and agree to pay cleaning fees accordingly if these conditions are not met.
In addition, you must agree that Sweet Pedals, its parent company, contractors and employees will not be held liable for any loss, injury or damage whatsoever, to either yourself or to any other person, that may arise in connection with participation during the hire period for the equipment you hire.
Sweet Pedals reserves the right to refuse service in any circumstance where we, at our sole discretion, judge that the above terms and conditions may not be met or adhered to.
Website terms of service
By using this website, you agree to these terms and you represent that you are at least 18 years of age, or that you have given us your consent to allow any of your minor dependants to use this site.
You may not use our products for any illegal or unauthorised purpose nor may you, in the use of this website, violate any laws in your jurisdiction (including but not limited to copyright laws).
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of these terms will result in an immediate termination of your service and the possibility of legal action.
We reserve the right to update, change or replace any part of these terms by posting updates to our website. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
GENERAL CONDITIONS
We reserve the right to refuse service to anyone for any reason at any time.
You understand that your content (not including credit card information), may be transferred un-encrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of this website without express written permission by Sweet Pedals.
PROHIBITED USES
In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet. We reserve the right to terminate your use of the Service or any related website for violating any of the prohibited uses.
DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of this website is at your sole risk. The service and all products and services delivered to you through this website are (except as expressly stated by us) provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, accuracy of description or images, durability and non-infringement.

COLLECTING PERSONAL INFORMATION
We won’t collect personal information from you unless it’s necessary for the service we’re providing you with.
When we ask you for personal information, we’ll explain why we need it. We’ll only ever use the information for that purpose.

Sweet Pedals uses your IP address and cookies to help understand how our services are being used and to improve your experience of our website.

Like many websites, we use Google Analytics to help us to understand how people arrive at our site, and what they do while they’re here. This helps us to understand what features people value and what they don’t so that we can focus on making our site even better.

Sustainability and waste minimisation policy
Sweet Pedals is committed to reducing any waste associated with our activities and limiting our impact on the environment where ever possible.
We only use 100% compostable cups.
We support and promote the use of re-usable drink cups and other re-usable items.
We do not supply straws, lids, spoons or napkins as standard. Where these items are specifically requested, we will source and supply 100% compostable items.
We run a post-event composting service and compost all fruit scraps and discarded cups from our events.
We distribute left-over produce items to community via local Grow-free networks and community foodbanks.
We support and encourage good maintenance practices and up-cycling/recycling where ever we can in sourcing and maintaining our equipment.
We're always happy to hear your suggestions and work with you to continually improve our sustainability practices.
Competitions, promotions and giveaways
Smoothilicious launch promotion - open 12pm 18 September 2019 to 11.59pm, 13 October 2019. NOW CLOSED.
Hey Adelaide! Help set the scene for the brand new Smoothilicious pedal powered drink station and
you could WIN a crewed Smoothilicious bike blender drinks package at your event to crank out delicious smoothies for you and all your mates!
Simply comment at what event - and where - you'd love to have the Smoothilicious drink station pedalling smoothies, and then be sure to like & follow the Sweet Pedals Facebook page. The most creative, fun and unusual entry in the opinion of the Sweet Pedals crew will be selected as the prizewinner and announced via the Sweet Pedals Facebook page on 14 October 2019. Full terms and conditions are below.
Entry criteria and conditions
Promotion is open to individuals over 18 years residing in Adelaide, South Australia only.
Winning event venue must be located within 30 km radius of Adelaide CBD.
Only 1 entry per contestant is permitted.
Contestants enter the promotion at their own risk.
Contestants acknowledge a complete release of Facebook, Instagram from any liability associated with this promotion.
Contestants acknowledge that by submitting an entry to the Smoothilicious Launch Promotion their comment will be publicly visible via Facebook.
The Sweet Pedals Privacy Policy applies to all interactions between promotion participants and Sweet Pedals, with the addition of consent to promotional photography taking place at the winning event and related images subsequently being used by Sweet Pedals for promotional purposes.
Contestants are responsible for any and all expenses incurred in entering the competition and acknowledge they will not be reimbursed regardless of whether or not they win the prize.
Winning entry must be posted as a comment on the Facebook post announcing the Smoothilicious Promotion by a genuine individual Facebook account that "likes" and follows the Sweet Pedals Facebook Page at fb.com/ohsweetpedals
Minimum of 25 separate valid entries to the promotion must be received for promotion to be activated and a winning entry to be chosen.
The most imaginative and creative entry provided by an individual with a genuine Facebook account, who also meets entry criteria and "Likes" and follows the Sweet Pedals Facebook page will be chosen as the prize winner.
Sweet Pedals decision on the most imaginative and creative entry is final.
Prize is a "Smoothilicious" 90 minute serviced drink station package, as listed for hire on our bookings page. Drink station will be serviced by a single crew member and will serve up to 25 non-alcoholic 300ml smoothies, in 2 seasonal flavours, across a 90-minute period. Smoothie flavours are subject to seasonal availability.
Total prize value is AUD$549. No cash prize or any other alternative whatsoever is available.
Winning entry will be selected from entries posted on the promotional post at Sweet Pedals Facebook page at fb.com/ohsweetpedals on 14 October 2019 and winner announced on the Sweet Pedals Facebook page.
Contestants acknowledge that the selected prize winner, together with the winning entry, will be re-posted publicly on the Sweet Pedals Facebook page.
Prize must be claimed through the same social media account that posted the winning entry.
Prize will be forfeited if not claimed within 3 business days of the winner being announced via the Sweet Pedals Facebook Page.
Prize is subject to the Sweet Pedals equipment availability schedule and a date for the prize winning event to take place must be agreed between Sweet Pedals and the prizewinner to take place within 3 months of the claim date.
Proof of identity may be required to activate prize when it is claimed.
Contestants consent to Sweet Pedals undertaking photography at the winning event event, and distributing the images with due credit, via our website, Social Media channels, and printed materials for promotional purposes.
You must own any images posted to Sweet pedals social media pages and have the express permission of the subject to distribute any photos.
Additional drinks, flavours, crew, customisation or other services associated with the prize must be requested and agreed upon with Sweet Pedals at least 14 days before your event and will be subject to an additional charge.
For the purpose of this promotion, prizewinner will be considered a 'hirer' of Sweet Pedals equipment and service.
Prize is subject to the terms and conditions in the Sweet Pedals standard hire agreement, requiring the responsible winning party to sign a standard waiver and agree to indemnify Sweet Pedals against all claims of liability in relation to the prizewinner's hire and related use of Sweet Pedals equipment and services.
Service of alcoholic drinks using Sweet Pedals equipment is strictly forbidden.
Sweet Pedals reserves the right to withdraw the prize completely if, for any reason we believe it may be unsafe, illegal, or that there may be risk of any kind what-so-ever to our staff, event participants or third parties, in delivering and activating the prize.
Sweet Pedals reserves the right to withdraw the prize completely if it becomes evident upon delivery that access to the venue is restricted, unsafe, or that the winning party is not legally entitled to use of the venue chosen at the time agreed or for the purposes stated.
Sweet Pedals reserves the right to request evidence of adequate Public Liability Insurance cover if the winning event is attended by members of the public, or is in a publicly accessible venue. We reserve the right to withdraw the prize completely if evidence of valid and adequate Public Liability Insurance cover cannot be provided.
A single rescheduling of the agreed upon delivery date will be permitted, provided at least 3 working days notice prior to the originally scheduled and agreed upon date is given to Sweet pedals AND the proposed rescheduled date is available in the Sweet Pedals schedule of bookings. - i.e we have to agree to the rescheduled date. Only 1 rescheduling will be permitted.
Prize will be withdrawn immediately if at any time following selection of the winning entry, it becomes clear the contestant or entry is ineligible based on any of these entry criteria.
Contestants may withdraw their entry at any time by deleting their own commented entry on the Smoothilicious Launch Promotion post on the Sweet Pedals Facebook page at fb.com/ohsweetpedals
